Elevate Buyers Agents

These Terms and Conditions (“Terms”) govern the services provided by Elevate Buyers Agents (“we,” “us,” “our”) to you (“you,” “your,” “client”). By engaging our services, you agree to these Terms. If you do not agree, please refrain from using our services.

1. Scope of Services

Elevate Buyers Agents provides professional property buyer’s agency services, including but not limited to property searches, appraisals, negotiations, and related advisory services. The specific scope of services will be outlined in our agreement or engagement letter.

2. Engagement and Fees

2.1 Exclusive Engagement

By engaging us, you agree to appoint Elevate Buyers Agents as your exclusive buyer’s agent for the agreed duration.

2.2 Fees and Payment

A retainer fee is required upon signing the agreement and is non-refundable unless otherwise stated. A success fee is payable upon the successful purchase of a property as outlined in the engagement agreement.

2.3 Additional Costs

You are responsible for any additional costs incurred, such as valuation fees, building inspections, pest inspections, and legal fees.

3. Responsibilities of the Client

3.1 Disclosure of Information

You agree to provide accurate and complete information regarding your property preferences, financial capacity, and any other details necessary for us to provide our services.

3.2 Decision-Making

All decisions regarding property purchase, including price, terms, and conditions, are your responsibility.

4. Limitation of Liability

4.1 No Guarantee

We do not guarantee that you will secure a property or that a property purchased will meet your expectations in all respects.

4.2 Exclusion of Liability

To the fullest extent permitted by law, we are not liable for any loss or damage arising from decisions made based on our advice, any issues related to the condition, title, or legal status of a property, or market conditions or changes affecting property value.

5. Confidentiality

We will maintain the confidentiality of any information you provide, except as required by law or as necessary to perform our services.

6. Termination

Either party may terminate the agreement in writing with reasonable notice. Any fees or costs incurred up to the date of termination remain payable.

7. Compliance with Laws

We comply with all relevant laws and regulations governing property transactions. You agree to comply with applicable laws, including but not limited to financial and legal obligations related to property purchases.

8. Dispute Resolution

In the event of a dispute, both parties agree to attempt to resolve the matter through negotiation or mediation before pursuing legal action.

9. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
